They might sue, but I doubt they'd win. Going with your argument, the parallel would be that they would have to prove that Nintendo's wrist straps were an insufficient saftey net for the type of playing you do with the wii-mote. Considering the game can be played just as well with small jerks of the wrist, I really dont see anyone willing this case
