In the mid 90's McDonalds was sued by a woman who poured scalding hot coffee on her crotch. She won over 2 million because she was able to demonstrate that the coffee she purchased was hotter than whatever McDonalds decided should be the normal temperature. Because of what people call legal precident, no matter if these people are scammers, or stupid, or have seizures, if they can demonstrate that the strap breaks under normal use, they've got a lawsuit and Nintendo would be liable.
